TERMS OF SERVICE

Welcome to NF Eats, nfeats.io (the “Website”), and the related mobile applications (the “App”) operated on behalf of Bangsig Corp. (“Company”, “we” or “us” or “our”). These Terms and Conditions (“Terms”) constitute a legally binding agreement between Company and each registered or unregistered end user (each, a “User,” “you” or “your”) of the NFT Platform located at the Website or such other URL as may be designated by Company from time to time, as well as any mobile apps or other related services or applications thereto (collectively, the “NFT Platform”). The NFT Platform and any content, tools, features and functionality offered on or through our Website and the App, including making available Company NFTs (as defined below) for purchase or sale, are collectively referred to as the “Services.”

 

Please carefully review these Terms. These Terms govern your access to and use of the Services. By accessing and using the Services (including by creating an Account or by purchasing or bidding on any items), you are deemed to have read, accepted, executed and agreed to be bound by these Terms. We may change or amend the Terms at any time at our sole and absolute discretion. Any changes to the Terms will be in effect as of the “LAST REVISED” date referred to at the top of this page. You acknowledge and agree that the form and nature of the Services, and any part of it, may change from time to time without prior notice to you, and that we may add new or remove existing features and change any part of the Services. If you do not understand or agree to these Terms, please do not use the Services. For purposes of these Terms, “you” and “your” means you as the user of the Services.

 

If you use the Services on behalf of a company or other entity then “you” includes you and that entity, and you represent and warrant that (a) you are an authorized representative of the entity with the authority to bind the entity to these Terms, and (b) you agree to these Terms on the entity’s behalf.

IF ANY PROVISION OF THESE TERMS OR ANY FUTURE CHANGES ARE UNACCEPTABLE TO YOU, DO NOT USE OR CONTINUE TO USE THE SERVICES AND DO NOT CREATE AN ACCOUNT. YOUR CONTINUED USE OF THE SERVICES FOLLOWING THE POSTING OF ANY NOTICE OF ANY CHANGE TO THESE TERMS OF SERVICE SHALL CONSTITUTE YOUR ACCEPTANCE AND AGREEMENT TO SUCH CHANGE.

Chapter 1 General Provisions

Article 1 (Purpose)

The purpose of this terms and conditions of use (hereinafter referred to as this “Terms and Conditions”) is to prescribe the conditions, procedures, and requirements for the use of ‘COVID-19 Checkup Service’ (hereinafter referred to as “Service”) provided by the NF Eats team.

Article 2 (Notices and Effectiveness of this Terms and Conditions)

①     The NF Eats team notifies the user of the contents of this Terms and Conditions by the application screen or homepage (hereinafter referred to as “application screen, etc.”)

②    The NF Eats Team takes steps to enable you to ask and answer questions regarding the contents of this Terms and Conditions.

③    The NF Eats team may revise this Terms and Conditions to the extent that it does not violate the relevant Acts, such as the 「Act on Promotion of Information and Communications Network Utilization and Information Protection」, etc.

④    Agreement of this Terms and Conditions means that you agree to visit the Service regularly to check any changes made to this Terms and Conditions. The NF Eats team is not responsible for any damage caused by users who do not know the changed Terms and Conditions.

⑤    If the user does not agree to the application of revised Terms and Conditions, the user may terminate the Service contract.

Article 3 (Definition of terms)

①    The terms used in this Terms and Conditions are defined as follows.

a)    Service: All Services provided by the NF Eats team, which are available to users by all feasible devices such as PCs, smartphones, tablets, etc.

b)    User: All customers using this Service

Chapter 2 Service Contract

Article 4 (Establishment of Service Contract)

The Service contract is concluded when the user agrees to this Terms and Conditions and applies for Service use after completing the entered matter, and the NF Eats team approves the application.

Chapter 3 Obligations and Responsibilities

Article 5 (NF Eats Team’s Obligations)

①    The NF Eats team does not engage in any prohibited or unfavorable acts, following the Acts and this Terms and Conditions, and does its best to provide continuous and stable service as prescribed by this Terms and Conditions.

②   The NF Eats team does not send advertising e-mails for profit that users do not want.

③   The NF Eats team must receive complaints from users by e-mail, etc. If an opinion or complaint raised by the user is objectively reasonable, it must be handled immediately and the reason and the processing schedule must be notified to the user, if it is difficult to handle immediately.

Article 6 (User’s Obligations)

①    Unless there is a NF Eats team’s explicit agreement, the user’s right to use is limited to the individual, and cannot be transferred, donated or provided as collateral.

②   The user cannot perform any of the following subparagraphs’ acts when using the Service.

a)    An act of entering false information or using the others’ personal information when applying for Service use or changing information

b)     An act of violating third party rights, or copyrights, etc.

c)    Business activities, such as selling goods or services by using the Service

d)    An act of illegally distributing software or hacking or advertising or promoting pornographic sites

e)    An act of impersonating an executive, employee, or official of the NF Eats team.

f)     An act of damaging the reputation of the NF Eats team or a third party.

g)    An act of interrupting the official provision of Service by the NF Eats team or a third party;

h)    An act objectively judged to be related a crime.

i)     An act of violating other regulations or conditions of use, prescribed by the NF Eats teams, including this Terms and Conditions

j)     An act of violating other relevant Acts

Chapter 4 Use of Service

     Article 7 (Service time)

①  In principle, the Service is open 24/7. However, the Service may be suspended for a period set by the NF Eats team due to system inspection, extension, and replacement failures. In this case, the NF Eats team will notify the Service in advance or after the interruption.

② The NF Eats team may temporarily or permanently suspend the Service in the following cases without prior notice or notice.

 a) In case of emergency system inspection, extension, replacement, failure or malfunction

 b) In case of compelling reasons, such as a national emergency, power outage, or natural disasters

 c) In case of using the Service is hindered by the excessive using of the Service

③ In case of Service interruption under the preceding paragraph, the NF Eats team notifies the user of the notice in advance. However, it is not the case that advance notice is not possible for Service interruption that the NF Eats team cannot control.

Article 8 (damage compensation, etc.)

① The NF Eats team do not enter into any agreements or warranties on any particulars not specified in this Terms and Conditions with respect to the Service within the statutory limits. In addition, the NF Eats team do not guarantee the reliability, accuracy, etc. of information, data, facts, or illegality posted on the Service by the founder or the user, and dol not take any responsibility except in cases of intentional or gross negligence by the NF Eats team.

② The NF Eats team must compensate the user for damages in accordance with these Terms and Conditions and acts if the user suffers damage due to the fault of the NF Eats team. However, the NF Eats team must not be responsible for the following damages.

 a) The NF Eats team do not be liable for any medical practice based on NF Eats data.

 b) If the NF Eats team is unable to provide Service due to natural disasters, wars, and other force majeure equivalent thereto, it shall be exempted from responsibility for providing Service.

c) The NF Eats team must be exempted from responsibility in the event of damages caused by the carrier’s failure to suspend or provide telecommunications Service normally.

d) The NF Eats team shall be exempted from responsibility for damages caused by unavoidable reasons, such as repair, replacement, regular inspection, and construction of Service facilities, except in cases of intentional or gross negligence.

e) The NF Eats team do not be held liable for any failure or damage caused by the user’s imputation, except in the case of intentional or gross negligence of the NF Eats team.

f) The NF Eats team dol not be held responsible for damages caused by a user’s computer error, or for damages caused by the user’s poor personal information and e-mail address.

g) The NF Eats team do not be held responsible for the failure or loss of the user’s expected profit using the Service.

h) The NF Eats team do not be held liable for damages caused by data obtained by the user using the Service, except in the case of intentional or gross negligence of the NF Eats team.

i) The NF Eats team do not be responsible for compensating users for mental damage caused by other users who use the Service.

j) The NF Eats team do not be obliged to intervene in disputes arising through the medium of Service between users and users and third parties, nor shall it be liable to compensate for damages caused by such disputes.

③ In the event that a damage occurs to the NF Eats team due to an illegal act committed by the user while using the Service and the violation of the provisions of this Terms and Conditions, or that the NF Eats team receives a claim for damages or various objections from a third party, the user shall compensate for the damage incurred to the NF Eats team.

 Article 9 (jurisdiction and governing law)

① Matters not specified in this Terms and Conditions shall be governed by the laws and regulations of the Republic of Korea.

② If a lawsuit is filed against a dispute arising from the use of the Service, the court having jurisdiction over the address under the Civil Procedure Act shall be the jurisdiction of the agreement.

Supplementary provisions

Article 1 (Enforcement Date)

① This Terms and Conditions shall enter into force on Febuary 16, 2022.
